Pre separation advice is for anyone who is unhappy in their relationship and is thinking about leaving their marriage or relationship.

What is Pre Separation advice?

Pre separation advice is not marriage or relationship counselling. It is legal advice that is give if you are considering or thinking about leaving your marriage or relationship.

You will be given advice regarding the care arrangements of your children, your entitlements to property or spousal support and what it means to be legally separated.

Pre separation advice is a confidential advice session where you can find out about your legal rights and entitlements should you decide to finally separate.

Has your relationship broken down irretrievably?

The first step to deciding whether you wish to separate is deciding whether your relationship has broken down irretrievably. It may be that your relationship is going through a difficult patch or a significant event such as illness or unemployment has impacted your relationship in a negative way.

Before you decide to separate, it is strongly recommended that you speak to a professional relationship or marriage counsellor. There may be ways that you can remedy or salvage the relationship.

I have decided to separate – now what?

If you have decided to separate on a final basis, then think about:

» Diarising and recording the date of your separation. The date of your separation is very important.

» Consider telling your partner about the separation at a time that is safe, and where the children are out of the home. If you have experienced family violence take measures to protect yourself and the children. It is okay to let your partner know that the relationship is over when you and the children have left the home or in the presence of another person.

» Gather all your financial documents and make copies of your partners financial documents if they are available.

» If you and your partner share common passwords or joint bank accounts, take steps to change your passwords and open a new bank account.
